شرایط و قوانین استفاده از برهه

۱. موضوع و پذیرش شرایط

این شرایط، رابطه شما با ارائه دهنده برهه را در استفاده از وب‌سایت، افزونه مرورگر، حساب کاربری و خدمات مرتبط مشخص می‌کند. در این متن، «برهه» و «ما» به ارائه دهنده معرفی‌شده در ابتدای سند اشاره دارد.

با ساخت حساب، موافقت خود را با این شرایط اعلام می‌کنید. اگر آن‌ها را نمی‌پذیرید، از ساخت حساب و ادامه استفاده از خدمات خودداری کنید. این شرایط برای استفاده مهمان و استفاده با حساب کاربری اعمال می‌شود.

۲. ماهیت و حدود خدمات

برهه ابزاری برای مدیریت و شخصی‌سازی تب جدید مرورگر است و بسته به نسخه، امکاناتی مانند تقویم، مدیریت کارها، بوکمارک، ابزارک، پس‌زمینه، جستجو و قابلیت‌های هوشمند ارائه می‌کند. نصب و فعال‌سازی افزونه می‌تواند صفحه تب جدید مرورگر را با برهه جایگزین کند.

دسترسی به بعضی امکانات به حساب، اینترنت، مجوز مرورگر یا سرویس‌های ثالث وابسته است. قابلیت‌هایی که با عنوان «به‌زودی» معرفی می‌شوند، هنوز بخشی از امکانات قابل استفاده نیستند و معرفی آن‌ها، تعهد به عرضه در تاریخ مشخص ایجاد نمی‌کند.

۳. اهلیت و حساب کاربری

برای پذیرش این شرایط باید اهلیت قانونی لازم را داشته باشید. اگر طبق قانون قابل اعمال، استفاده شما به اجازه ولی یا نماینده قانونی نیاز دارد، این اجازه باید پیش از استفاده فراهم شود. اگر از طرف یک سازمان اقدام می‌کنید، باید اختیار لازم برای پذیرش تعهد های مربوط به آن را داشته باشید.

برای ایجاد حساب یا اتصال روش ورود، باید از شماره، ایمیل یا حسابی استفاده کنید که مجاز به استفاده از آن هستید. اطلاعات لازم را درست وارد و در صورت تغییر به‌روز کنید. از کدهای یک‌بارمصرف، حساب Google و دستگاه‌های دارای دسترسی به برهه محافظت کنید و دسترسی مشکوک را به پشتیبانی اطلاع دهید. صرف انجام یک فعالیت با حساب شما، مسئولیت قانونی ما در قبال نقص یا تخلف منتسب به خودمان را از بین نمی‌برد.

۴. حالت مهمان و نگهداری اطلاعات

بخشی از اطلاعات و تنظیمات برهه ممکن است در مرورگر یا دستگاه شما نگهداری شود و بخش دیگری، هنگام استفاده از حساب یا خدمات آنلاین، روی سرور پردازش شود. جزییات این پردازش در سیاست حریم خصوصی توضیح داده می‌شود.

پاک‌کردن اطلاعات مرورگر، حذف پروفایل مرورگر یا حذف افزونه می‌تواند اطلاعات محلی را از دسترس خارج کند. ورود به حساب به معنی همگام‌شدن همه اطلاعات محلی نیست؛ دامنه همگام‌سازی به امکانات فعال بستگی دارد. برای اطلاعات مهم، نسخه‌ای مستقل نگه دارید. این توصیه مسوولیت‌های قانونی برهه را ساقط نمی‌کند.

۵. مجوز استفاده و حقوق برهه

در چارچوب این شرایط، اجازه دارید از امکانات در دسترس برهه برای امور شخصی یا فعالیت‌های مجاز کاری خود استفاده کنید. این اجازه به معنی انتقال مالکیت نرم‌افزار، نام، نشان یا طراحی برهه نیست.

بازفروش دسترسی، عرضه نسخه تغییر یافته به نام برهه یا استفاده گمراه‌کننده از نشان تجاری، بدون مجوز مجاز نیست. حقوقی که قانون یا مجوز مستقل اجزای متن‌باز و دارایی‌های ثالث به شما می‌دهد، با این بند محدود نمی‌شود.

۶. محتوای شما

حقوقی که نسبت به کارها، یادداشت‌ها، بوکمارک‌ها، تصاویر و سایر محتوای خود دارید، برای شما یا صاحب حق مربوط باقی می‌ماند.

با وارد کردن محتوا، فقط در حد لازم برای ذخیره‌سازی، نمایش به خودتان، همگام‌سازی، حفاظت و اجرای قابلیت‌هایی که درخواست می‌کنید، اجازه پردازش آن را به برهه و ارائه دهندگان ضروری خدمت می‌دهید. این اجازه به معنی انتقال مالکیت، انتشار عمومی، استفاده تبلیغاتی یا اجازه مستقل آموزش مدل با محتوای خصوصی شما نیست.

با حذف محتوا یا حساب کاربری، مجوز پردازش مربوط به آن محتوا خاتمه می‌یابد، مگر در حدودی که نگهداری یا پردازش برای تکمیل فرایند حذف، رعایت الزامات قانونی یا پایان دوره نگهداری نسخه‌های پشتیبان طبق سیاست حریم خصوصی ضرورت داشته باشد.

شما نیز باید برای محتوایی که وارد می‌کنید، حق استفاده یا مجوز لازم را داشته باشید و حقوق دیگران را رعایت کنید.

۷. استفاده‌های غیرمجاز

استفاده از برهه برای فریب، جعل هویت، دسترسی بدون اجازه به حساب یا اطلاعات دیگران، انتشار بدافزار، نقض حقوق مالکیت فکری یا حریم خصوصی، و سایر فعالیت‌های غیرقانونی مجاز نیست.

همچنین نباید محدودیت‌های امنیتی، دسترسی یا مصرف را دور بزنید یا با درخواست‌های خودکار نامتعارف، عملکرد خدمت را مختل کنید. استفاده‌های مجاز قانونی و بررسی امنیتی هماهنگ‌شده، در حدود مجوز مربوط، مشمول منع استفاده نادرست نیستند.

۸. جستجو و خدمات ثالث

برخی امکانات برهه به خدماتی مانند موتور جستجو، ورود Google، آب‌وهوا، قیمت‌ها، تصاویر یا ارائه دهندگان هوش مصنوعی وابسته‌اند. داده لازم برای استفاده از هر قابلیت ممکن است به ارائه دهنده مربوطه ارسال شود.

وب‌سایت یا خدمت ثالث شرایط مستقل خود را دارد. نمایش لینک یا نام آن در برهه به معنی تضمین محتوا یا تایید همه فعالیت‌های آن نیست. این موضوع مسئولیت ما را نسبت به نحوه اتصال، انتقال داده یا نمایش اطلاعات در بخش تحت کنترل خودمان رفع نمی‌کند. ورود با Google نیز به‌تنهایی به معنی اتصال یا دسترسی برهه به Google Calendar یا Gmail نیست.

۹. قابلیت‌های هوشمند و اطلاعات متغیر

اگر از قابلیت‌های هوشمند یا متصل به هوش مصنوعی فعال استفاده کنید، ورودی درخواست و اطلاعات لازم برای انجام آن می‌تواند برای پردازش به ارائه دهنده مربوطه ارسال شود.

خروجی هوش مصنوعی ممکن است اشتباه، ناقص یا نامناسب باشد. پیش از اعمال یا اتکا به آن، نتیجه را بررسی کنید. قیمت‌ها، آب‌وهوا، مناسبت‌ها، زمان رویدادها و اوقات شرعی نیز ممکن است به‌دلیل منبع، زمان به‌روزرسانی، موقعیت یا تنظیمات زمانی اختلاف داشته باشند. برای تصمیم‌های مالی، پزشکی، حقوقی، مهلت‌های حساس و سایر تصمیم‌های مهم، منبع معتبر و به‌روز را بررسی کنید؛ برهه جایگزین مشاوره تخصصی یا مرجع رسمی مربوط نیست.

۱۰. هزینه و امکانات پولی

هر هزینه باید پیش از خرید، همراه امکانات، دوره و شرایط مربوط روشن اعلام شود. استفاده از امکانات رایگان، به‌تنهایی تعهدی برای خرید آینده یا اجازه برداشت وجه ایجاد نمی‌کند.

در صورت ارائه اشتراک یا امکانات پولی، شرایط پرداخت، تمدید، لغو و بازپرداخت پیش از خرید مشخص و جداگانه پذیرفته می‌شوند. این سند به‌تنهایی مجوز تمدید خودکار یا برداشت وجه نیست و حقوق الزامی مصرف‌کننده را محدود نمی‌کند.

۱۱. دسترس‌پذیری، تغییر خدمت و مسئولیت

برای نگهداری و بهبود عملکرد برهه تلاش می‌کنیم، اما دسترسی همیشگی، نبود خطا یا مناسب‌بودن همه امکانات برای هر نیاز را تضمین نمی‌کنیم. اختلال اینترنت، مرورگر، نگهداری فنی یا خدمات ثالث می‌تواند بر عملکرد اثر بگذارد. قابلیت آزمایشی با وضعیت خود معرفی می‌شود.

ممکن است امکانات تغییر کنند یا متوقف شوند. تغییر مهمی که بر استفاده یا دسترسی به اطلاعات شما اثر می‌گذارد، تا حد معقول و در موارد لازم پیشاپیش اطلاع‌رسانی می‌شود. مسئولیت هر طرف مطابق قانون و نقش او در ایجاد خسارت تعیین می‌شود. هیچ بندی، مسئولیت غیر قابل اسقاط یا حقوق الزامی شما را حذف نمی‌کند؛ محدودیت‌های فنی نیز مجوز بی‌احتیاطی در حفاظت از اطلاعات نیستند.

۱۲. توقف استفاده، محدودیت حساب و حذف اطلاعات

می‌توانید استفاده از برهه را متوقف یا افزونه را از مرورگر حذف کنید. حذف افزونه و خروج از حساب، به معنی حذف خودکار اطلاعات سرور نیست. برای درخواست حذف حساب، اطلاعات یا دریافت نسخه‌ای از داده‌های قابل ارائه، از راه تماس زیر اقدام کنید. برای جلوگیری از دسترسی غیرمجاز، ممکن است احراز مالکیت متناسب لازم باشد.

1. Subject and acceptance

These terms set out your relationship with the provider of Borhe when you use the website, browser extension, user account, and related services. In this text, “Borhe” and “we” refer to the provider identified at the beginning of the document.

By creating an account, you agree to these terms. If you do not accept them, do not create an account and do not continue using the services. These terms apply both to guest use and to use with a user account.

2. Nature and scope of the service

Borhe is a tool for managing and personalizing the browser’s new tab. Depending on the version, it offers features such as a calendar, task management, bookmarks, widgets, backgrounds, search, and smart features. Installing and enabling the extension can replace the browser’s new-tab page with Borhe.

Access to some features depends on an account, an internet connection, browser permissions, or third-party services. Features introduced as “coming soon” are not yet part of the features you can use, and introducing them does not create a commitment to release them on a particular date.

3. Legal capacity and user account

To accept these terms, you must have the legal capacity required to do so. If applicable law requires permission from a parent or legal representative for your use, that permission must be in place before you use the service. If you act on behalf of an organization, you must have the authority needed to accept the related obligations.

To create an account or connect a sign-in method, you must use a phone number, email address, or account that you are allowed to use. Enter the required information correctly, and update it if it changes. Protect one-time codes, your Google account, and devices that can access Borhe, and report suspicious access to support. The mere fact that an activity was carried out with your account does not remove our legal responsibility for a defect or violation attributable to us.

4. Guest mode and keeping information

Some of Borhe’s information and settings may be kept in your browser or on your device. Another part may be processed on a server when you use an account or online services. The details of this processing are explained in the privacy policy.

Clearing browser data, deleting a browser profile, or removing the extension can make local information unavailable. Signing in to an account does not mean that all local information is synced. The scope of syncing depends on the features that are enabled. Keep an independent copy of important information. This recommendation does not discharge Borhe’s legal responsibilities.

5. License to use and Borhe’s rights

Under these terms, you may use the available features of Borhe for your personal matters or for permitted work activities. This permission does not transfer ownership of Borhe’s software, name, mark, or design.

Reselling access, offering a modified version under the name Borhe, or using the trademark in a misleading way is not allowed without permission. Rights given to you by law, or by a separate license for open-source components and third-party assets, are not limited by this section.

6. Your content

The rights you have in your tasks, notes, bookmarks, images, and other content remain with you or with the relevant rightsholder.

By entering content, you give Borhe and the necessary service providers permission to process it only as needed to store it, display it to you, sync it, protect it, and run the features you request. This permission does not transfer ownership, authorize public publication or advertising use, or give a separate permission to train a model on your private content.

When you delete content or your account, the permission to process that content ends, except to the extent that keeping or processing it is necessary to complete the deletion process, comply with legal requirements, or finish the retention period for backup copies under the privacy policy.

You must also have the right, or the permission required, to use the content you enter, and you must respect the rights of others.

7. Prohibited uses

You may not use Borhe to deceive, impersonate someone, access another person’s account or information without permission, distribute malware, infringe intellectual-property or privacy rights, or carry out other illegal activities.

You also must not bypass security, access, or usage limits, or disrupt the service with unusual automated requests. Uses permitted by law, and coordinated security testing, are not subject to the prohibition on improper use when they stay within the relevant permission.

8. Search and third-party services

Some Borhe features depend on services such as a search engine, Google sign-in, weather, prices, images, or artificial-intelligence providers. The data needed to use a feature may be sent to the relevant provider.

A third-party website or service has its own separate terms. Showing its link or name in Borhe does not guarantee its content or endorse all of its activities. This does not remove our responsibility for how a connection is made, how data is transferred, or how information is displayed in the part under our own control. Signing in with Google does not, by itself, mean that Borhe is connected to Google Calendar or Gmail, or that Borhe can access them.

9. Smart features and variable information

If you use smart features, or features connected to artificial intelligence, that are turned on, the input of the request and the information needed to carry it out may be sent to the relevant provider for processing.

Artificial-intelligence output may be wrong, incomplete, or unsuitable. Review the result before you act on it or rely on it. Prices, weather, occasions, event times, and prayer times may also differ because of the source, the time of the update, the location, or the time settings. For financial, medical, and legal decisions, sensitive deadlines, and other important decisions, check a reliable and up-to-date source. Borhe is not a substitute for specialized advice or for the relevant official authority.

10. Fees and paid features

Any fee must be stated clearly before purchase, together with the related features, period, and terms. Using the free features does not, by itself, create a commitment to a future purchase or permission to take a payment.

If a subscription or paid features are offered, the terms for payment, renewal, cancellation, and refund are set out separately and accepted before purchase. This document alone is not permission for automatic renewal or for taking a payment, and it does not limit mandatory consumer rights.

11. Availability, changes to the service, and responsibility

We work to maintain and improve how Borhe performs, but we do not guarantee uninterrupted access, the absence of errors, or that every feature is suitable for every need. A disruption of the internet, the browser, technical maintenance, or a third-party service can affect performance. An experimental feature is presented with its own status.

Features may change or be discontinued. An important change that affects your use, or your access to your information, is announced in advance to a reasonable extent and where that notice is needed. Each party’s responsibility is determined according to the law and that party’s role in causing the loss. No section removes liability that cannot be waived, or your mandatory rights. Technical limitations are also not permission to be careless in protecting information.

12. Stopping use, account limits, and deletion of information

You may stop using Borhe, or remove the extension from the browser. Removing the extension and signing out of the account does not automatically delete information stored on the server. To request deletion of an account or of information, or to receive a copy of the data that can be provided, use the contact method below. To prevent unauthorized access, proportionate verification of ownership may be required.
